Two different situations, with different rules

Reading this website

Visiting this site collects almost nothing. There is no analytics product, no tag manager, no advertising pixel and no third party embed. The web server keeps ordinary access logs, which is how any web server works and how abuse is investigated.

  • One cookie is set for an ordinary visitor, remembering the language you are reading
  • No profile is built and no automated decision is made
  • Nothing you read here is shared with a marketing platform

Contacting us or instructing us

Once you get in touch, we hold what you send: your name, the contact details you use, and whatever you tell us about the document. If you instruct us, we then hold identity documents and the instrument itself.

  • Held so we can answer you and carry out the work
  • Identity documents are collected because notarial law requires identification
  • Notarial records are retained because the notarial rules require it

What we collect, and why

Your name and contact details

So we can answer your enquiry and reach you about the matter.

What you tell us about the document

So we can identify the right instrument and calculate the government fee correctly.

Identity documents

Emirates ID and passport. Collected because a notary is required to identify the parties. This is not optional and it is not something we can skip.

The instrument itself

The document being notarised, which forms part of the notarial record.

Records of the act

What was done, when, and for whom. A notarial act is a matter of record by its nature.

Server access logs

Held by the hosting platform in the ordinary course, for security and troubleshooting.

Why we are allowed to hold it

Under the PDPL, processing needs a lawful basis. Ours are:

  • Your consent, when you send us an enquiry. You chose to contact us and we use what you sent to reply
  • Performance of a contract, when you instruct us and we carry out the work
  • A legal obligation, for identification of parties and for the retention of notarial records. This is the basis that we cannot set aside even at your request
  • Legitimate interests, for keeping the website secure and for keeping records of what we were asked and what we advised

Who else sees it

Notarial acts are registered with Dubai Courts. That is the point of the act, and the information required for registration goes into the Dubai Courts system.

Beyond that, information is shared only where it is necessary to do the work you asked for, or where the law requires it. That can include a translator engaged for your document, a court or authority that lawfully requires it, and the practice’s professional advisers.

The website is hosted by a commercial hosting provider, and email is carried by a commercial email provider. Both hold data in the ordinary course of providing those services. If you want to know who they are and where they hold data before you send us anything sensitive, ask and we will tell you.

How long we keep it

Enquiries that do not become instructions are kept only as long as they are useful for answering you and for our own record of what was asked, and are then deleted. If you would like an enquiry deleted sooner, ask and we will do it.

Notarial records are kept for the period the notarial rules require. That period is set by the rules that bind the practice, not chosen by us, and it is the reason a request to delete a notarial record cannot always be granted.

Server logs are kept for the period the hosting platform retains them.

Transfers outside the UAE

Some service providers used by any modern practice operate outside the UAE, and the PDPL sets conditions on transfers of personal data abroad. Where a transfer happens, it is limited to what is necessary to provide the service in question.

If the location of your data matters to you, tell us before you send anything, and we will tell you what applies to your matter and to the channel you want to use. If you would rather not send documents electronically at all, bring them to the office.

Your rights

Ask what we hold

You can ask what personal information we hold about you and why.

Ask us to correct it

If something we hold is wrong, tell us and we will correct it.

Ask us to delete it

We will delete what we are free to delete. Notarial records that the law requires us to retain are the exception, and we will tell you plainly when that applies.

Withdraw consent

Where consent is the basis, you can withdraw it. That does not undo processing already carried out lawfully.

Object or restrict

You can object to processing based on legitimate interests, and ask us to restrict processing while a question is resolved.

Complain

If you are not satisfied with how we handled a request, you can complain to the UAE Data Office.

To exercise any of these, call +971 50 747 9570 or email info@privatenotaryindubai.ae. We will acknowledge your request promptly and tell you how long it will take. We may need to verify your identity first, which for a notary practice is not a formality.

Keeping information secure

Access to client files is limited to the people working on the matter. Identity documents are held for identification and are not reused for other purposes. The website is served over HTTPS.

No system is perfectly secure, and email in particular is not a private channel. If a document is sensitive, bring it to the office or ask us about a secure route rather than attaching it to an email.

Children

This practice’s services are for adults. We do not knowingly collect information about children through this website. Where a matter concerns a child, such as a travel consent, the information is provided by the parent or guardian in the ordinary course of the instruction.

Changes to this policy

We update this page when what we do changes. The review date at the top tells you when it was last considered. Where a change is significant we will say so on the page rather than change it quietly.

Questions

If any part of this policy is unclear, or you want to know exactly what happens to a specific document before you send it, ask. That question is always worth asking and it is never a nuisance.

Describe the task rather than the document name. You will get back the instrument you need, a list of what to bring, and the cost split between the government fee and ours, in writing, before anything starts.
